Terms & Conditions

These terms should be reviewed and adapted by a qualified Spanish lawyer before real launch. Spafindo is a trade name of PRIVA SPA, S.L. (sociedad unipersonal), registered office Paseo Jesús Santos Rein 2, Edificio Ofisol, 2º-A, Fuengirola (Málaga), Spain; NIF/CIF and Registro Mercantil de Málaga data pending following the company's recent incorporation.

1. Who we are & what Spafindo is

Spafindo (a trade name of PRIVA SPA, S.L.) is an online marketplace ("the Platform") that lets users discover and book entire private spa & sauna suites by the hour in Spain — currently on the Costa del Sol (Marbella, Mijas, Estepona, Fuengirola, Benalmádena and Málaga).

Spafindo acts solely as an intermediary. The actual spa, sauna and wellness service is provided by the independent venue you select ("the Venue", the service provider). Spafindo facilitates discovery, booking and payment, but is not the operator of the facilities and is not a party to the wellness service itself, which is contracted directly between you and the Venue.

By using the Platform or completing a booking, you accept these Terms & Conditions together with our Privacy Policy and Cookie Policy.

2. Marketplace Terms & Conditions

2.1 The intermediary relationship

The contract for the wellness service is concluded directly between the user and the Venue. Spafindo is responsible for the proper functioning of the booking and payment intermediation service, while the Venue is responsible for the provision, quality, safety, licensing and condition of the physical suite and its facilities.

2.2 Booking & payment

A booking is confirmed once payment is successfully authorised and you receive a confirmation. All prices shown on the Platform include VAT (IVA incluido). Payments are processed through a licensed third-party Payment Service Provider (PSP) such as Stripe.

PSD2 / SCA. Payments are subject to Strong Customer Authentication under Directive (EU) 2015/2366 (PSD2), handled by the PSP. Spafindo does not store full card details.

2.3 Commission & IVA

Spafindo earns an intermediation commission. The commission charged to Venues is subject to 21% Spanish VAT (IVA). Where a service fee applies to the user, it is shown transparently before payment.

2.4 Cancellations & changes

The cancellation policy is disclosed at the time of booking:

• More than 24 hours before the start time: full refund of the booking amount.
• Within 24 hours of the start time, or no-show: non-refundable.

Specific Venues may set stricter or more generous terms, always shown before you confirm. Refunds are returned through the original PSP.

2.5 Right of withdrawal (Art. 103.l TRLGDCU)

Dated bookings. Bookings are for leisure services provided on a specific date or period. Under Article 103.l of the Spanish Consumer Act (Royal Legislative Decree 1/2007, TRLGDCU), the 14-day right of withdrawal does not apply to leisure services with a specific date of performance; the cancellation tiers in section 2.4 apply instead. By booking, you expressly acknowledge this. Gift vouchers are not tied to a date and can be returned within 14 days of purchase, as set out in section 2.8.

2.6 Liability

Spafindo is liable only for its intermediation service. Liability for the wellness experience, the suite's condition, hygiene, safety and any injury or damage on the premises lies with the Venue. Nothing in these Terms limits liability that cannot lawfully be excluded.

2.7 Health, safety & minimum age

Saunas, steam rooms and hot tubs involve high temperatures. They are not recommended during pregnancy or for people with cardiovascular conditions, abnormal blood pressure or other relevant medical conditions — if in doubt, consult your doctor before booking. Do not combine heat sessions with alcohol: where venues offer drinks such as champagne, they are intended for the lounge area, never inside the sauna or hot tub. Guests must be at least 18 years old (or accompanied by an adult where the Venue admits minors). Follow the Venue's safety instructions, stay hydrated and keep sauna sessions to comfortable intervals.

2.8 Gift vouchers

Spafindo gift vouchers are valid for 5 years from the date of purchase and can be redeemed at any Spafindo suite. Gift vouchers bought online can be returned within 14 days of purchase for a full refund, as long as they have not been redeemed. Bookings for a specific date are exempt from the right of withdrawal (art. 103.l of the Spanish Consumer Act); our cancellation policy applies instead.

2.9 Platform transparency (Art. 97 bis TRLGDCU)

In line with Article 97 bis TRLGDCU: (a) listings can be filtered by area and ordered by price; there is no relevance ranking of listings today and no Venue can pay for a higher position, and if relevance ranking or promoted placements are ever introduced they will be clearly labelled; (b) all Venues offering services through the Platform are professional traders (empresarios), so consumer-protection law applies to your bookings; (c) the Venue is responsible for delivering the spa session, while Spafindo handles booking, payment and customer support.

3. Miscellaneous

These Terms are governed by Spanish law. Consumer disputes may be addressed to the competent courts of the consumer's domicile. We may update these Terms; the version in force is always published here.
